These are the terms of service for SimEX Pay, in draft. Last updated 30 July 2026. Straight from the start: our legal partner has not finished reviewing these terms, and the sections that need proper legal drafting are marked incomplete. We are publishing the draft now so the businesses working with us can see exactly what we offer, and where the gaps still are.

1. What SimEX Pay is

SimEX Pay is a payments platform for small businesses in the UK. It gives you a point-of-sale for taking orders and payments, a QR menu your customers can browse and order from themselves, card payments through Stripe smart readers, and tools to sync or export your sales into your accounting.

They describe the service as it exists today, and they will be reviewed and completed by our legal partner before full launch. If anything changes in that review, we will update this page and the date at the top.

2. Your account

You sign in to SimEX Pay through Clerk, our sign-in provider. You are responsible for keeping your sign-in details secure and for what happens under your account.

When you register your business, the information you give us (business name, what you sell, contact details) must be accurate. We pass it to Stripe to set up your payments, so inaccurate details can delay or block your ability to take them.

3. Payments run on Stripe

All card payments on SimEX Pay are processed by Stripe. When you join, a Stripe connected account is created for your business. Stripe's own Connected Account Agreement therefore applies to you alongside these terms, and identity verification (the checks on your business and its owners) is carried out by Stripe, not by us.

SimEX Pay never holds your money. Payments settle through Stripe into your connected account and are paid out to you by Stripe. Your funds do not pass through our bank accounts at any point.

4. Fees

You pay one fee per payment: a percentage plus a fixed 20p. That is the whole price list:

There is no monthly fee, no contract and no minimum term. You can leave whenever you like.

  • 0.89% + 20p per transaction for Pay by Bank
  • 1.79% + 20p per transaction for standard domestic cards
  • 2.80% + 20p per transaction for premium domestic cards
  • 3.40% + 20p per transaction for all international cards, premium included

5. Refunds and disputes

You can issue full or partial refunds to your customers directly from your dashboard. One thing to know: when you refund a payment, Stripe's processing fees on the original transaction are not returned, so a refund costs slightly more than the amount you took.

Chargebacks and disputes raised by cardholders are handled through Stripe and follow Stripe's dispute process. We show dispute activity in your dashboard where we can, but the process itself (deadlines, evidence, outcomes) runs through Stripe.

6. Your data and leaving

Your transaction data is yours. You can export it to CSV whenever you like, not just on the way out.

If you decide to stop using SimEX Pay, there is no exit penalty and no notice period. Export your data and you are free to go. We keep records for as long as UK tax law requires; beyond that, our privacy policy (pending the same legal review) explains how we handle personal data.

7. Acceptable use

SimEX Pay is for lawful business use in the UK. You must not use it for any business or activity on Stripe's list of restricted businesses. Stripe publishes and maintains that list, and because your payments run on Stripe, it applies to you directly.

If your business falls into a restricted category, Stripe can suspend or close your connected account under its own agreement. In that case we would no longer be able to provide payment services to you either.

8. Service basis, liability and governing law (to be completed)

We provide SimEX Pay with care and we work to keep it reliable. The sections covering limitation of liability, warranties, governing law, and how formal disputes between you and us would be resolved will be completed in legal review before launch.

The same goes for our formal legal entity details, which will be added once confirmed. When these sections are finalised, we will update this page and flag the change clearly.
